If you have decided to buy a house in Mallorca, it’s important to pay attention to several key aspects to ensure everything goes well.

One of the first aspects to consider is the issue of savings. Although you may need to apply for a mortgage, it is advisable to have saved approximately 30% of the property’s price, besides meeting the optimal conditions for the bank to grant you the mortgage, such as job stability.

Another point to consider is the time. Buying a property requires investing time in searching, viewing, and paperwork. It’s important to dedicate time and effort to find the ideal house and ensure the documentation is in order to avoid delays or future issues.

Last but not least is the documentation. It’s important to have ready documents like the property’s simple note and a valid ID or residence card to carry out the transaction efficiently and without hitches.

Buying a property is an important decision, and therefore, it’s essential to have all the necessary documentation. We advise you to review this documentation:

  • Simple note: it confirms ownership and the charges on it.
  • Cadastral record: You can check cadastral information on the Electronic Headquarters of the Cadastre to ensure its correspondence with the simple note and verify its validity.
  • Reference value: Since January 1, 2022, the reference value is the minimum base for the taxation of the property transfer tax (ITP) for second-hand properties.
  • Occupancy certificate: It’s a document that certifies the property meets the minimum conditions of habitability and health required by local and regional regulations in Spain.
  • Energy Efficiency Certificate: it indicates the energy efficiency of a property or building and is used to inform owners and potential buyers or tenants about the energy consumption and CO₂ emissions associated with the property or building.
  • Receipts of municipal taxes: it allows you to know if the owner has paid the corresponding taxes, such as the Property Tax (IBI) and garbage fees. We advise you to request the last 4 years.
  • Utility bills: they will help you know if the property is up to date with the payment of basic services such as electricity, water, and gas.

These are some of the documents you should review before buying a property. It is also advisable to request the debt certificate with the homeowners association and documents that prove the legality of some parts of the property, such as a pool.

If the property you intend to purchase is already mortgaged, it is important to carefully evaluate the situation. We recommend that you follow these steps:

  • Review the terms of the existing mortgage. You may be interested in taking over the current mortgage through a change of ownership. As long as the Bank allows it.

  • If you’re not interested in taking over the mortgage, you can ask the seller to cancel the existing mortgage before the sale. This means the mortgage’s cancellation must be registered in the Property Registry before finalizing the purchase.

  • Cancellation on the same day of purchase before a notary. You can purchase the property and request that on the same day of your purchase before the notary, the mortgage cancellation be executed at the same notary. In this case, it’s very important to ensure that a bank representative attends the signing and that the cancellation deed is registered afterward.

In any case, it’s essential to ensure the property is sold free of charges. This way, you can be sure you’re buying the property without pending charges that could affect your ownership.

If you are applying for a mortgage, an official appraisal is mandatory and must be carried out by an independent company approved by the Bank of Spain. This appraisal will impartially value the property according to the ECO/805/2003 Order.

However, even if you’re not applying for a mortgage, it’s recommended to appraise the property you wish to buy to verify its market value compared to the sale price.
